April 20, 2007 Disclosure - Summary of Exemption Motions Heard and/or Approved

By way of letter, which was dated April 20, 2007, Parliament disclosed the following particulars of six (6) Exemption Motions to the Contractor General.

Senator Col. Trevor McMillan

An Exemption Motion was granted to Senator Col. Trevor McMillan on October 27, 2006, by the Senate. Senator McMillan is a director of Security Advisory and Management Company Ltd. (SAMS Ltd.)  “which as at the 13th of October 2006, entered into contracts with Air Jamaica and the Petroleum Corporation of Jamaica Ltd., companies owned by the GOJ, to provide management and security consulting services”.

 

The Exemption Motion does not disclose the values or any further details of the subject contracts.

 

Hon. K. D. Knight, M.P., Q.C.

On July 18, 2006, the Deputy Leader of the House moved an Exemption Motion in relation to the Hon. K. D. Knight, M.P. Mr. Knight is a partner in the law firm of Knight, Junor and Samuels “which has entered into a contract with the Financial Sector Adjustment Company Ltd. for the purchase of part of the premises located at 4 Duke Street to carry out the business of a law firm which may from time to time provide services to government entities”.

 

The Exemption Motion does not disclose the value or any further details of the subject contract between Knight, Junor and Samuels and the Financial Sector Adjustment Company Ltd. Additionally, the Exemption Motion does not disclose details as to the Public Body/Bodies which has/have engaged or will be engaging the services of Knight, Junor and Samuels nor does it disclose the details and/or value of any current and/or prospective contract(s).

 

The Ethics Committee of the House of Representatives, to which the Motion was referred, recommended that the Exemption Motion should be approved. The recommendation, which was embodied in the Committee’s March 2007 Report to the House of Representatives, was adopted by the House by way of Resolution on March 27, 2007.

 

Mr. John Junor, M.P.

On July 18, 2006, the Leader of the House moved an Exemption Motion in relation to the Hon. John Junor, M.P. Mr. Pearnel Charles, M.P.

On July 18, 2006, the Leader of the House moved an Exemption Motion in relation to the Hon. Pearnel Charles, M.P. Mr. Charles is a director of St. Thomas Farms Limited which has entered into a contract with “the Sugar Company, a company owned by the GOJ, to lease to that company lands at Pera in the parish of St. Thomas for growing sugar cane”.

 

The Exemption Motion does not disclose the value of the contract or the terms of the lease. The Ethics Committee of the House of Representatives, to which the Motion was referred, recommended that the Exemption Motion should be approved. The recommendation, which was embodied in the Committee’s March 2007 Report to the House of Representatives, was adopted by the House by way of Resolution on March 27, 2007.

 

Mr. Errol Ennis, M.P.

On November 28, 2006, the Deputy Leader of the House moved an Exemption Motion in relation to the Hon. Errol Ennis, M.P., the Minister of State in the Ministry of Agriculture and Lands. Mr. Ennis is a director of Petagaye Development Company Limited, “which is currently in the process of selling some lands to the GOJ in connection with the third leg of the North Coast Highway”.

 

The Exemption Motion does not disclose the quantity or location of the subject lands nor the value or other terms of the subject contract(s). The Ethics Committee of the House of Representatives, to which the Motion was referred, recommended that the Exemption Motion should be approved. The recommendation, which was embodied in the Committee’s March 2007 Report to the House of Representatives, was adopted by the House by way of Resolution on March 27, 2007.

 

Mr. John Junor, M.P.

On January 30, 2007, the Deputy Leader of the House moved an Exemption Motion in relation to the Hon. John Junor. M.P. Mr. Junor “is currently in the process of entering into a contract with the GOJ for the purchase of property at 28 Dewsbury Avenue, Kingston 6.”

 

The Ethics Committee of the House of Representatives, to which the Motion was referred, deliberated on and deferred Mr. Junor’s exemption request to “purchase a house” as it felt that “it needs to have further deliberations before it approves the Exemption Motion”. The resolution of deferment, which was embodied in the Committee’s March 2007 Report to the House of Representatives, was adopted by the House by way of Resolution on March 27, 2007.
